Agreement
An engagement begins when you accept a written proposal and pay the deposit it specifies. The proposal sets out the scope, the price, the timeline and the deliverables for your project.
Quotes and pricing
Quotes are valid for 30 days and are fixed for the scope described. Prices are shown in US Dollars unless your proposal states otherwise. The currency you are invoiced in is agreed in the proposal and is not adjusted for exchange-rate movement during the project.
Payment terms
Projects are split into a deposit and milestone payments, typically 50% to begin and the balance on delivery. Retainers are invoiced monthly in advance. Work may be paused if an invoice is overdue by more than 14 days.
Client responsibilities
You agree to provide content, brand assets, access and timely feedback. Delays in supplying these shift the delivery date by at least the length of the delay.
Revisions and scope changes
Each phase includes two rounds of revisions. Anything beyond the agreed scope is quoted separately and only starts once you approve that quote in writing.
Intellectual property
On final payment you own the deliverables, including the source code, design files and content we produced for you. We retain the right to showcase the work in our portfolio unless we agree otherwise in writing.
Warranty and support
We fix defects in what we delivered, free of charge, for 30 days after launch. Ongoing changes, new features and third-party maintenance are covered by a support retainer.
Liability
Our total liability for any engagement is limited to the fees you paid for it. We are not liable for indirect or consequential losses, including lost profit or lost data.
Termination
Either party may end an engagement with 14 days written notice. Work completed up to that point is invoiced and payable, and completed deliverables are handed over on settlement.
Governing law
These terms are governed by the laws named in your proposal, and the courts sitting in that jurisdiction have exclusive jurisdiction over any dispute. Where a proposal does not name a jurisdiction, the laws and courts of the studio's place of business apply.
